This notice describes how information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Introduction

This Notice of Privacy Practices is being provided to you on behalf of Pacific Northwest Fertility with respect to reproductive medical services provided at Pacific Northwest Fertility’s facilities (collectively referred to herein as “We” or “Our”). We understand that your medical information is private and confidential. Further, we are required by law to maintain the privacy of “protected health information.” Protected health information includes any individually identifiable information that we obtain from you or others that relates to your past, present or future physical or mental health, the health care you have received, or payment for your health care.

Your Rights

Although your health record is the physical property of Pacific Northwest Fertility, you have the right to:

  • request a restriction on certain uses and disclosures of your information as provided by applicable law

  • obtain a paper copy of this Notice of Privacy Practices upon request

  • inspect and copy your health record as provided for by applicable law

  • request an electronic copy of your electronic health record

  • request to amend your health record as provided by applicable law

  • obtain an accounting of disclosures of your health information as provided by applicable law.

  • request communications of your health information by alternative means or at alternative locations

  • revoke your authorization to use or disclose health information except to the extent that action has already been taken

  • request a restriction of disclosure of your health information to your health insurer for services for which you pay “out of pocket” in full

  • transmit copies of your health information to third parties when requested by you, in writing

Our Responsibilities:

We are required to:

  • maintain the privacy of your health information

  • provide you with a notice as to our legal duties and privacy practices with respect to information we collect and maintain about you

  • abide by the terms of this notice

  • notify you if we are unable to agree to a requested restriction

  • accommodate reasonable requests you may have to communicate health information by alternative means or at alternative locations

  • where required by law, notify you in the event that there has been a breach of your unsecured health information

We reserve the right to change our practices and to make the new provisions effective for all protected health information we maintain. Should our information practices change, we will post the revised Notice of Privacy Practices on our website at www.pnwfertility.com as well as at our offices and provide you with a hard copy upon request.

We will not use or disclose your health information without your authorization, except as described in this notice. We will not sell your health information (unless permitted by law) or use or disclose such information for paid marketing (for which we receive payment from a third party) without your authorization. If we obtain your authorization, you may revoke it at any time, and this revocation will take effect except where we have already relied upon your authorization.

Permitted Uses and Disclosures

We will use and disclose your health information for treatment. For example: information obtained by a nurse, physician or other member of your healthcare team will be recorded in your record and used to determine the course of treatment that should work best for you. Your physician will document in your record his/her expectations of the members of your healthcare team.

Members of your healthcare team will then record the actions they took and their observations. In that way the physician will know how you are responding to treatment. We will also provide your physician or a subsequent healthcare provider with copies of various reports that should assist him/her in treating you once you’re discharged from this practice.

We will use and disclose your health information for payment. For example: A bill may be sent to you or a third-party payer, such as an insurance company or health plan, for the purposes of receiving payment for treatment and services that you receive. The information on the bill may contain information that identifies you, your diagnosis, and treatment or supplies used in the course of treatment.

We will use and disclose your health information for our health care operations. For example: Members of the clinical staff, the risk or quality improvement manager, or members of the quality improvement team may use information in your health record to assess the care and outcomes in your case and others like it. This information will then be used in an effort to continually improve the quality and effectiveness of the healthcare and the reproductive medicine service we provide.

Other Uses or Disclosures of Protected Health Information

Business Associates: There are some services provided at Pacific Northwest Fertility through contacts with business associates. For example: We may disclose your health information to our business associates, such as outside laboratories so they can perform the job we have asked them to do, and bill you or your third party payor for services rendered. So that your health information is protected, however, we require the business associate to appropriately safeguard your information.

Notification: We may use or disclose information to notify or assist in notifying a family member, personal representative, or another person responsible for your care, your location, and general condition.

Communication with Spouse/Family: Health professionals, using their best judgment, may disclose to your spouse, family member, or any other person you identify, health information relevant to that person’s involvement in your care or payment related to your care. We will give you an opportunity to object to these disclosures, and we will not make these disclosures if you object.

Research: We may disclose information to researchers when their research has been approved by an Institutional Review Board that has reviewed the research proposal and established protocols to ensure the privacy of your health information.

Marketing: Where permitted by law, we may contact you to tell you about or recommend possible treatment alternatives or other medical technology and services that may be of interest to you. We may also seek your authorization to contact you with other marketing communications.

Food and Drug Administration (FDA): We may disclose to the FDA health information relative to adverse events with respect to food, supplements, product and product defects or post marketing surveillance information to enable product recalls, repairs or replacement.

Public Health: As required by law, your health information may be used or disclosed for public health activities such as assisting public health authorities or other legal authorities to prevent or control disease, injury, disability or for other health oversight activities.

Law Enforcement: We may disclose health information for law enforcement purposes as required by law, or in response to a valid subpoena. Federal law makes provision for your health information to be released to an appropriate health oversight agency, public health authority or attorney, provided that a workforce member or business associate believes in good faith that we have engaged in unlawful conduct or have otherwise violated professional or clinical standards and are potentially endangering one or more patients, workers or the public.

Note: HIV-related information, genetic information, mental health records and other specially protected health information may be subject to certain special confidentiality protections under applicable State and Federal law. Any disclosures of these types of records will be subject to these special protections.

This website is owned and operated by Pacific Northwest Fertility (“PNWF” or “we”, “us” or “our”). This Privacy Policy applies to PNWF’s website located at pnwfertility.com as well as all other websites owned, operated, licensed, or controlled by PNWF (collectively, the “Websites”). This Privacy Policy also applies to all mobile applications offered under the PNWF name that do not have a separate privacy policy or that link to this Privacy Policy (the “Apps”). Collectively, the Websites and Apps are referred to in this Privacy Policy as the “Services.”

BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THIS PRIVACY POLICY AND THE TERMS OF USE. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY OR THE TERMS OF USE, DO NOT ACCESS OR USE THE SERVICES.

This Privacy Policy applies to the use of the Services and the information provided by and obtained from users of the Services. PNWF maintains a separate policy in connection with the Health Portability and Accountability Act (“HIPAA”) that can be viewed HERE.

INFORMATION THAT WE COLLECT

PNWF collects two types of information: (1) personally identifiable information that you provide voluntarily when you access certain features of the Services as noted below in this Privacy Policy, and (2) generalized usage information that we collect automatically as you access the Services.

Information That You Provide Voluntarily on the Websites. PNWF collects personally identifiable information that you enter into data fields on the Websites. When you register for a service/event, or when you use certain services provided by the Site, such as asking a question, requesting an appointment, signing up to receive a newsletter, attending an event or inquiring about a clinical study, you may be asked for certain personally identifiable information, including but not limited to your name and email address. Other features of the Websites may ask for other personally identifiable information necessary for the proper functionality of such features. If you decline to provide certain information while using the Websites, you may not be able to use or participate in some or all of the features offered through the Websites. We may retain email and other communications that you send us in order to process your inquiries, respond to your requests, and improve the Services. PNWF also collects and stores personally identifiable information that you enter during chats and that you enter into pre-chat surveys.

Information That You Provide Voluntarily on the Apps. PNWF collects personally identifiable information that you enter into data fields on the Apps. Other features of the Apps may ask for other personally identifiable information necessary for the proper functionality of such features. If you decline to provide certain information while using an App, you may not be able to use or participate in some or all of the features offered through the App. PNWF also collects and stores personally identifiable information that you enter during chats and that you enter into pre-chat surveys.

Usage Information That Is Automatically Collected on the Websites. When you access the Websites, PNWF may collect certain generalized information without your actively providing such information. This information may include, for example, your browser type, your operating system, and your IP address. This information may be collected using various technologies including cookies, as explained below.

Usage Information That Is Automatically Collected on the Apps. When you access the Apps, PNWF may collect certain generalized information without your actively providing such information. This information may include, for example, the type of mobile device you are using and your mobile operating system. When you access certain Apps, we may assign to you a unique analytics tracking identification number (ID). PNWF uses this ID to collect generalized information about your interaction with the Apps in order to improve your experience of the Apps. Certain Apps may also use location services to provide location-based features. If you enable location services on your device and grant permission for such Apps to access this feature, we may collect your location via GPS in order to provide you with such features.

HOW WE USE INFORMATION THAT WE COLLECT

PNWF uses the personally identifiable information that it collects to ensure the proper functionality of the Services across various devices, to process user inquiries and respond to user requests, to analyze usage trends, to improve the Services, and to develop new Services.

PNWF employs a variety of online security measures to safeguard and keep your information private.

PNWF processes personally identifiable information only for the purposes for which it was collected and in accordance with this Privacy Policy.

Certain features on this Site request information about you which will be forwarded to a member of PNWF to respond to your question or inquiry. If you fill out a contact form online you will be contacted by a representative of PNWF. If you provided your telephone number online you may be contacted by a representative of PNWF in order to provide you with the information you requested. A privacy notice pursuant to the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) is made available at the time any prospective or actual patient first receives services from a member of PNWF.

PNWF does not share your personally identifiable information with third parties without your consent, except for third-party suppliers that perform essential business or administrative services for us (for example, our web hosting provider). PNWF provides these suppliers only with the information they need to perform such services and asks that they either comply with this Privacy Policy or maintain comparable privacy policies that protect your personally identifiable information.

Under confidentiality agreements, we may match user information with third party data. We also may disclose aggregate demographic and/or user information and statistics in order to describe our customer base to prospective partners and other third parties, and for other lawful purposes.

When you download and access the Apps, PNWF may send you push notifications to alert you of important information. If you no longer wish to receive such communications from us, you may disable them at the mobile device level.

PNWF takes reasonable steps to ensure the security of its website infrastructure and data, including hosting the site in a secure data facility and encrypting network and data transmissions, we make no guarantees or warranties concerning the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction or inadvertent disclosure of personally identifiable information.

DO WE SELL OR RENT YOUR PERSONALLY IDENTIFIABLE INFORMATION?

No, as a general rule, we do not sell or rent your personally identifiable information to anyone. However, we may from time to time rent or sell demographic information in the aggregate that does not contain your personally identifiable information.

COOKIES

PNWF may place small data files, called “cookies,” on your computer or other device. Cookies are a standard web technology that allow us to both store and retrieve login information on a user’s system. These cookies automatically identify your browser to our server whenever you interact with a service provided on the Services. However, PNWF wishes to assure the integrity of the Services and their destination links, so any comments pertaining to the Services or any websites accessed through our links are greatly appreciated. Comments can be submitted by using the web form on the Contact Us portion of our website.

LEGAL MATTERS

The Services are not intended for use by children under the age of 18. In accordance with the Children’s Online Privacy Protection Act of 1998 (COPPA), PNWF does not knowingly request personally identifiable information from anyone under the age of 13 without parental consent. When we do receive information (with parental consent) from users under the age of 13, we will not share their personally identifiable information with third parties, regardless of their stated preference given at registration, in compliance with COPPA.

JURISDICTION

PNWF does not provide services outside of the United States. If you are located outside of the United States, by submitting information to PNWF you are consenting to our processing of your data in the United States in accordance with this Privacy Policy.

INDEMNITY

You agree to defend, indemnify, and hold Pacific Northwest Fertility, its officers, directors, employees, agents, affiliates, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.

GENERAL

Pacific Northwest Fertility is based in Seattle, WA in the United States of America. Pacific Northwest Fertility makes no claims that the Content is appropriate or may be downloaded outside of the United States. Access to the Content may not be legal by certain persons or in certain countries. If you access the Pacific Northwest Fertility Site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. The following provisions survive the expiration or termination of these Terms and Conditions for any reason whatsoever: Liability, User Submissions, Indemnity, Jurisdiction, and Complete Agreement.

JURISDICTION

You expressly agree that exclusive jurisdiction for any dispute with Pacific Northwest Fertility, in any way relating to your use of the Site, resides in the courts of the State of Washington and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Washington in connection with any such dispute including any claim involving Pacific Northwest Fertility or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers. These Terms and Conditions are governed by the internal substantive laws of the State of Washington, without respect to its conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

COMPLETE AGREEMENT

Except as expressly provided in a particular “legal notice” on the Site, these Terms and Conditions constitute the entire agreement between you and Pacific Northwest Fertility with respect to the use of the Pacific Northwest Fertility Site, and Content.
